     Prezado Associado,

Tendo em vista a paralização do processo eleitoral iniciado a partir da Portaria ASIBRAM nº001/2020, devido as restrições impostas pela pandemia de COVID-19, a diretoria executiva, em conjunto com a mesa eleitoral nomeada, utiliza deste para consultar os associados sobre a possibilidade de continuidade do processo eleitoral por mecanismos remotos.

Para realização do certame eleitoral, faz-se necessário ajuste no atual Estatuto Social, prevendo a legitimidade da utilização de ferramentas digitais. Entretanto, para alteração na normativa da associação é preciso a realização de assembleia geral, que a priori também poderia apenas ocorrer presencialmente.

Contudo, com o advento da Lei Federal nº14.010, de 10 de junho de 2020, torna-se viável a realização de assembleia geral remotamente:

“Art. 5º A assembleia geral, inclusive para os fins do art. 59 do Código Civil, até 30 de outubro de 2020, poderá ser realizada por meios eletrônicos, independentemente de previsão nos atos constitutivos da pessoa jurídica.

Parágrafo único. A manifestação dos participantes poderá ocorrer por qualquer meio eletrônico indicado pelo administrador, que assegure a identificação do participante e a segurança do voto, e produzirá todos os efeitos legais de uma assinatura presencial.”

Amparados pela Lei Federal acima, informamos que realizaremos assembleia geral para prestação de contas no mês de julho/2020 e sugerimos que seja feita alteração no regimento, nesta mesma oportunidade, para incluir dispositivo que viabilize a realização da eleição.

Esclarecemos que a mudança do Estatuto Social seria exclusivamente sobre o mecanismo de eleição, não abordando outras questões que merecem apreciação da assembleia, mas poderão ser feitas em outro momento. Assim, não serão propostas alterações na estrutura administrativa nem nas regras que tornam um associado elegível.

Ante o exposto, a proposta é realizar duas assembleias no mesmo dia em julho/2020, que teriam como pautas respectivas a prestação de contas e alteração do Estatuto Social para previsão de eleição remota.

Importante ressaltar que a atual diretoria tem a gestão prevista até agosto/2020, sendo que, vencidos os dois anos, perderá o acesso à gestão financeira junto ao Banco de Brasília – BRB, o que prejudicaria a continuidade administrativa da associação, que tem compromissos regulares a serem cumpridos.

Desta forma, convidamos a todos associados a participarem da consulta, que ficará disponível até às 23h59, do dia 24 de junho de 2020 (quarta-feira) no link (Consulta aos associados). Assim, caso seja constatada adesão dos associados para avançarmos nesta proposta, iniciaremos os tramites para realização das assembleias em julho/2020, com a intenção de realização de eleições em agosto/2020.
